DESCRIPTION of the judicial digital identity expert report type:

  • Analysis and assessment of the loss of notoriety, notability, theft, usurpation, or discredit of the digital identity, image, and reputation of an entity (commercial or personal) online.

 

ANALYSIS AND ASSESSMENT PROCESS:

  • Through tracking techniques (online monitoring) by keywords, URL, email, telephone numbers, usernames, and through analog identity.
  • Tools used: monitoring software in open or closed sources (with prior signed authorization from the client), Cyber-investigation software (OSINT techniques “Open Source Intelligence”), and digital certification of the tracked evidence.
  • An assessment is made of the impact (quantitative and qualitative) on the digital identity, image, and reputation of the affected party.
  • It is measured according to the following quantitative and qualitative criteria:
    • Notoriety (how well-known the entity is)
    • Notability (how recognized the entity is)

 

 

EVALUATION PROCEDURE

A.1) ANALYSIS OF CURRENT DIGITAL IDENTITY:

  • A positioning map of the current state of the digital identity is prepared (the number of entities is chosen, whether it be a commercial brand, number of products, number of users on social networks, and providing, in necessary cases, the analog identity of the possible aggressor, whether personal or organized).

 

A.2) Quantitative criteria

  • Search trends
  • Organic results in search engines: Google, Bing, Yahoo, Yandex… depending on the domain to be monitored
  • Identification of the nature of the attack
  • Identification of the digital identities of the possible aggressors and their technical identity

 

A.3) Qualitative criteria

  • Identification of currents of opinion (for and against)
    • Topics of digital conversation (what is being discussed, what it is associated with)
  • Identification of conversation spaces
    • Social media (blogs, forums, social networks, websites, news…): where the conversation is taking place
  • Identification of communicative hostility
    • Tone: How it is spoken about, the tone of the conversation
  • Identification of the degree of dissemination of the conversation
    • Level of exposure of personal information shared online (conscious or unconscious) and its danger level

 

B) ASSESSMENTS OF POSSIBLE LOSS OF IMAGE AND REPUTATION

B.1) Assessment of the loss of digital identity, image, and online reputation (quantitative and qualitative)

  • Comparison of the affected entity with:
    • Previous periods,
    • Possible competitors (level of visibility, awareness, or type of competition)

 

B.2) Assessment of the economic cost of the reputational loss and assessment of the average cost of Reconstruction and Improvement of the digital identity
