Eliminating the spread of fake news is one of the major challenges social networks face.

For example, on Twitter you can still find the video of a case in which immigrants were falsely criminalised. As this is a case that has been tried and sentenced, this video should be removed, but it is not. Why is it so difficult to delete this content?

According to Selva Orejón, “…technically, of course it can be done; the platform has sufficient artificial intelligence to allocate resources to remove this false content—you only have to see how quickly social networks such as Instagram remove content where a bare nipple appears”

In addition, as stated by Ricardo Rodriguez Ruiz, a magistrate specialising in the analysis of fake news, …”not removing it creates an effect of continuation of the criminal act, which is prohibited”.

On the other hand, although fake news related to hate crimes and discrimination are the most common, they are not the only ones. Other cases that can also be reported include public disorder offences, when a false alarm message is spread, or when the affected party is a private individual harmed by insults disseminated on social media.
