The publisher Wolters Kluwer has released the first issue of the journal “La Ley Probática,” corresponding to the July–September 2020 edition, titled “Unlawful Evidence: A Concept Still to Be Defined.”
Selva Orejón, Executive Director of onBRANDING, is also a judicial expert specializing in digital identity and reputation, and a member of the Catalan Association of Judicial and Forensic Experts. She contributed to this issue with her article titled “Novel Expert Specialties: Expert Reports on Calculating Intangible Losses with Economic Loss Costs and the Role of Technology.”

Selva Orejón clarifies:
“The expert report must consider the following points: Analysis and assessment of loss of notoriety and notability, verification of whether it involves theft, misappropriation, or impersonation of digital identity, and whether this has caused damage to the image itself and a consequent reputational impact on the entity (commercial or personal) online.
The analysis and assessment process is conducted using tracking techniques […].
Tracking is performed using monitoring software tools on open sources or closed sources (with prior signed authorization from the client), and if private investigation is required, with the collaboration of a detective.”
After an exhaustive analysis of the topic in the article, she concludes:
“Who is this type of expert report intended for? The entities that contract these services for assessing digital identity exposure, image loss, and online reputation analysis are: Private companies, independent professionals, non-profit organizations, public entities such as governments, or any citizen who is a victim of a digital crisis, a victim of repeated technology-related crimes, victims of hate crimes on the Internet, victims of organized negative opinions and/or lobbies.”
